The AHA filed an amicus brief on Friday urging that in resolving a lawsuit challenging CMS policy on Medicare payment for Observation stays, the court be sensitive to the difficult situation hospitals find themselves in being caught in a tug-of-war between beneficiaries and the government over the appropriate use of "observation." Proposed Rule on Medicare Overpayments Would Create Additional Burden

The Centers for Medicare & Medicaid Services (CMS) recently issued a proposed rule implementing a Patient Protection and Affordable Care Act (ACA) requirement that health care providers and suppliers report and return self-identified overpayments by the later of 60 days after the date the overpayment was identified, or the date any corresponding cost report is due, if applicable.
