CMS Solicits Input on the Application of EMTALA to Inpatients

On December 22, the Centers for Medicare and Medicaid Services (CMS) posted an advance notice of proposed rulemaking (ANPRM) regarding the applicability of the Emergency Medical Treatment and Labor Act (EMTALA) to hospital inpatients. CMS is soliciting comments through Feb. 21, 2011, on whether it should revisit its current policy on EMTALA application to inpatients. We are requesting your input on that approach.
Under current regulations, a hospital's EMTALA responsibilities are complete when a hospital, in good faith, admits an individual with an unstable emergency medical condition as an inpatient.
