COMMENTS SOLICITED ON DRAFT
From now until May 30, 2003, the State of Illinois will be taking comments and input on the DRAFT and will review and incorporate any changes in a final analysis. The State of Illinois wanted to take this opportunity to ensure that covered entities, organizations, and the general public had input to the final analysis.
BACKGROUND
The State of Illinois Departments of Public Health, Public Aid and Human Services joined together to have all the state laws, regulations, and court cases reviewed by an outside legal firm in light of the HIPAA privacy law and regulations.
The Illinois Attorney General's office has reviewed the pre-emption analysis and all of their changes have been included in the draft analysis.
PUBLIC DOCUMENT
Please note that this document is available to the public and will be widely used by covered entities and anyone reviewing HIPAA privacy and state pre-emption analysis. Illinois developed a creative approach that has allowed providers and all covered entities with a single solution for performing this analysis without expanding any resources for legal review. IHA urged the state to take a leadership role in this area and has been supportive of a single analysis that could be made publicly available to all.
