The Virginia Hospital & Healthcare Association and several other leading health care associations in the state retained the law firm of Troutman Sanders LLP to perform a preemption analysis. The HIPAA preemption analysis is designed to examine the interplay between the HIPAA privacy regulation and the Virginia laws (including the VA Administrative code) governing health care providers and confidentiality. The analysis recommends a course of compliance for health care providers. Whenever possible, the analysis attempts to resolve federal and state obligations in a manner that allows the health care provider to comply with both obligations. |
