Member https://www.aha.org/ en Hospital Price Transparency Final Rule https://www.aha.org/pricetransparencyrule <span class="title">Hospital Price Transparency Final Rule</span> <span class="uid"><span>dsamuels_drupal</span></span> <span class="created">Apr 12, 2021 - 04:34 PM</span> <div class="body"><div class="container"> <div class="row"> <div class="col-md-8"> <h3><strong>The Centers for Medicare &amp; Medicaid Services’ Hospital Price Transparency final rule goes into effect on Jan. 1, 2021.</strong></h3> <h2>Issue</h2> <p>The Centers for Medicare &amp; Medicaid Services’ (CMS) hospital price transparency final rule, issued Nov. 14, 2019, will require hospitals to provide an out-of-pocket price estimator tool or information on 300 “shoppable” services for patients as well as disclose their privately negotiated rates with health insurers, discounted cash prices and gross charges beginning Jan. 1, 2021. The agency will monitor and enforce compliance, including civil monetary penalties of up to $300 a day</p> <h2>AHA Take</h2> <p>Hospitals and health systems are committed to providing patients with meaningful information that patients can use to make the best decisions for themselves and their families, such as an out-of-pocket cost-estimator tool for shoppable services. However, the AHA continues to oppose the requirement to publicly list privately negotiated prices. That part of the rule will do nothing to help patients become more knowledgeable consumers of health care and instead will confuse and frustrate them. And, according to one large national health insurer, it will accelerate anticompetitive behavior by insurers with market power including stymieing badly needed innovations in care delivery.</p> <p>The U.S. Court of Appeals for the District of Columbia Circuit Oct.15 heard oral arguments in an appeal from the AHA and hospital groups challenging CMS’ final rule. We urged the court to overturn the rule and do so quickly due to the looming Jan.1 compliance deadline and the unreasonable burden it places on hospitals. Concurrent with our legal strategy, we have been working to prepare the field for the rule’s implementation, should it take effect on Jan. 1.</p> <h2>AHA Resources</h2> <p>AHA offers resources to help you meet patient demand for easier access to out-of-pocket cost estimates. class="uid"><span>dsamuels_drupal</span></span> <span class="created">Aug 03, 2021 - 04:47 PM</span> <div class="body"><div class="container"> <div class="row"> <div class="col-md-8"> <p>The Centers for Medicare &amp; Medicaid Services (CMS) yesterday issued the fiscal year (FY) 2022 <a href="https://public-inspection.federalregister.gov/2021-16519.pdf">final rule</a> for the inpatient and long-term care hospital (LTCH) prospective payment systems (PPS).</p> <p>This Special Bulletin reviews highlights of the LTCH provisions in this rule, while the inpatient PPS provisions are covered in a separate Special Bulletin.</p> <h2>AHA Take</h2> <p>The relatively brief LTCH payment provisions in this rule set forth required payment updates and minimal policy changes. We appreciate that the streamlined rule allows LTCHs to continue to focus on the COVID-19 public health emergency (PHE). That said, the AHA remains concerned that the implementation of the full site-neutral payment policy continues to present a challenge for some LTCHs, especially as site-neutral payments, on average, do not cover the cost of care. With regard to quality, while the AHA suggested an incremental – rather than immediate – implementation of the COVID-19 vaccination-among-health care personnel (HCP) measure, we plan to work with our members and CMS to gather this important data without unnecessarily increasing burdens on providers.</p> <p>Highlights from the rule follow.</p> <h3>FY 2022 Payment Update</h3> <p>When considering all LTCH provisions in the rule, CMS estimates that in FY 2022, compared to FY 2021, aggregate net spending on LTCH services will increase by 1.1%, or $42 million.</p> <p>To account for the impact of the COVID-19 public health emergency (PHE) on LTCH claims and other data in FY 2020, this rule modified CMS’ standing methodology used to calculate specific elements of the annual payment update. Specifically, the rule uses pre-PHE data from FY 2019 to set FY 2022 payment rates, instead of FY 2020 data. This modification is based on the agency’s belief “that the utilization patterns reflected in&nbsp;the FY 2020 LTCH claims data were significantly altered by the COVID-19 PHE.” In addition, the rule states that “data from before the COVID-19 PHE will better approximate the FY 2022 LTCH experience.” As such, final FY 2022 payments were calculated using FY 2019 claims instead of FY 2020 claims. For example, these FY 2019 data are used to calculate the inpatient PPS rates and factors that determine the “IPPS comparable amount” used by the LTCH short-stay outlier and site neutral payment policies.</p> <p><u>Standard Rate Update</u>. For FY 2022, this rule updates CMS’ prior estimate of the cases that will be paid a LTCH PPS standard rate (versus a site-neutral rate) from 75% to 90%. FY 2022 payments for this category of LTCH cases will increase by a net 0.9% (or $31 million) in FY 2022 compared to FY 2021. This update includes a 2.6% market-basket update that is offset by a statutorily mandated cut of 0.7 percentage points for productivity, a 0.8% cut for high-cost outlier (HCO) payments and a reduction for short-stay outlier cases. Thus, the standard rate in FY 2022 increases from the current rate of $43,755.34 to $ 44,713.67.</p> <p>With regard to updating the a high-cost outlier fixed-loss amount for LTCH standard rate cases, CMS acknowledges that the FY 2020 LTCH claims were significantly impacted by the COVID-19 PHE. As a result, the agency’s final LTCH HCO fixed-loss amount for FY 2022, $33,015, was calculated using LTCH claims data from the March 2020 update of the FY 2019 claims file. This increase is intended to reduce the number of HCO cases, and thereby maintain a HCO pool of 7.975% of aggregate payments to LTCHs, as required by law.</p> <p><u>Site-neutral Rate Update</u>. CMS estimates that in FY 2022, 25% of all LTCH discharges and 10% of aggregate LTCH payments will fall in the site-neutral category of the LTCH PPS two-tiered payment policy. For this category of cases, the rule yields a net increase of 3.0% (or $11 billion) over FY 2021. Site-neutral payment rates are paid the lower of the inpatient PPS-comparable per-diem amount, including any outlier payments, or 100% of the estimated cost of the case. For FY 2022, the HCO threshold for site-neutral cases will continue to mirror that of the inpatient PPS threshold: $30,988.</p> <p>For FY 2022, all site-neutral cases will receive the full site-neutral payment rate, instead of the prior 50/50 blend of LTCH PPS and site-neutral rates. We note that, as required by statute, the cost of the last two years of the blended-rate (cost reporting periods starting in FYs 2018 and 2019) is offset by a 4.6% payment cut to site-neutral payments in FYs 2018 through 2026. This offset is explained in CMS <a href="https://www.cms.gov/Regulations-and-Guidance/Guidance/Transmittals/2018Downloads/R4046CP.pdf">Transmittal 4046</a>.</p> <p>AHA analyses have found that site-neutral cases are underpaid by CMS, both under the prior blended rate and the current full site-neutral rate. This finding differs from CMS’ ongoing position that the costs and resource use for cases paid at the site neutral payment rate mirror the costs and resource use for IPPS cases assigned to the same MS-DRG. As such, we recognize that some LTCHs are facing challenges due to site-neutral payments not covering the cost of providing care, as indicated by the drop in the&nbsp;number of LTCHs reported in this rule (373) compared to those in existence at the time of the FY 2019 final rule (417).</p> <h3>LTCH Quality Reporting Program</h3> <p><u>COVID-19 Vaccination among Health Care Personnel (HCP) Measure</u>. CMS finalized its proposal to adopt a quality measure assessing the rate of COVID-19 vaccination among HCP beginning with the FY 2023 LTCH QRP. This process measure, which will also be adopted in other clinical settings, evaluates the percentage of HCP eligible to work in the LTCH for at least one day during the reporting period who received a complete vaccination course; it excludes persons with contraindications to COVID-19 vaccination as described by the CDC. LTCHs will submit data through the CDC National Healthcare Safety Network submission framework, which LTCHs currently use to report other data. LTCHs will be required to submit this data for at least one week each month, and the CDC will calculate a summary measure of the data each quarter. This rate will be publicly reported on the LTCH <em>Care Compare</em> website.</p> <p>The measure is not endorsed by the National Quality Forum, but CMS notes in the final rule that the agency and the CDC plan to submit the measure for consideration this fall. Despite the lack of testing or development of this measure, CMS considered it necessary to adopt the measure as soon as possible “given the novel nature of the SARS-CoV-2 virus, and the significant and immediate risk it poses in LTCH s.” LTCHs beginning on Oct. 1, 2021, will be required to submit data and their performance will be publicly reported beginning with the October 2022 <em>Care Compare</em> refresh.</p> <p><u>Other LTCH Quality Reporting Program (QRP) Proposals</u>. CMS will update the denominator of the Transfer of Health Information to the Patient (TOH-Patient) measure to exclude patients discharged to their homes under the care of a home health agency or hospice. This measure, first adopted in the FY 2020 LTCH PPS final rule to begin reporting with the FY 2022 LTCH QRP, evaluates the timely transfer of a medication list to the patient, family, and/or caregiver at the time of discharge to the home, board and care home, assisted living, group home, transitional living, home under the care of a home health agency or hospice. A similar measure, Transfer of Health Information to the Provider, was adopted in the same rule and assesses whether the medication list was transferred to a subsequent facility. However, both measures count patients discharged to the home under the care of a home health agency or hospice; to avoid counting the patient in both measures, CMS will remove these patients from the denominator of the TOH-Patient measure.</p> <p>CMS also finalized its proposal to begin public reporting for two measures, Compliance with Spontaneous Breathing Trial by Day 2 of the LTCH Stay and Ventilator Liberation Rate, beginning with the March 2022 <em>Care Compare</em> refresh. The inaugural display of the measures will use data collected in Q3 of 2020 through Q2 of 2021, and then four rolling quarters of data thereafter. These measures were first adopted in the FY 2018 IPPS/LTCH PPS final rule, and data collection began with assessments for patients admitted and discharged on or after July 1, 2018.</p> <p>Finally, CMS finalized its proposals regarding publicly reported data affected by COVID-19 reporting exemptions. In March 2020, CMS issued guidance granting an exception to the LTCH QRP reporting requirements from the last quarter of 2019 through the second quarter of 2020, stating that the agency would not publicly report any LTCH QRP data that might be greatly impacted by the exceptions from the first two quarters of 2020.</p> <p>In addition, CMS determined that freezing the data displayed on the <em>Care Compare</em> website – that is, holding the data constant after the October 2020 refresh without update – would be the best way to account for exempted data reporting. However, these data are increasingly out-of-date and less useful. Therefore, CMS will calculate assessment-based measures using data from Q3 of 2020 through Q1 of 2021 and claims-based measures using Q4 of 2018 through Q4 of 2019 and Q3 of 2020 for the January 2022 <em>Care Compare</em> refresh. Beginning with the April 2022 refresh, CMS will resume reporting with four quarters of data for assessment-based measures; public reporting based on eight quarters of data for claims-based measures would resume with the October 2023 refresh.</p> <h3>NEXT STEPS</h3> <p>The payment provisions in this final rule will generally take effect Oct. 1. Watch for a more detailed analysis of this rule. Key takeaways from the rule follow. &nbsp;</p> <h2>Final IPF PPS Payment Provisions&nbsp;</h2> <ul> <li>CMS in FY 2022 will increase IPF payments by a net 2.1%, equivalent to $80 million.</li> <li>The 2.1% payment update includes a 2.7% market basket update, a productivity cut of 0.7 percentage points, and a 0.1 percentage-point increase for the outlier fixed-dollar loss threshold amount.</li> <li>Under these payment updates, the federal per diem base rate will be $832.94 (an increase from the previous rate of $815.22). The electroconvulsive therapy (ECT) payment per treatment will be $358.60 (an increase from the previous rate of&nbsp; $350.97).</li> <li>The labor-related share for FY 2022 is updated to 77.2%, based on the revised market basket, which is a very slight decrease from the previous labor-related share of 77.3%.</li> </ul> <h2>Updates to the IPF Teaching Policy&nbsp;</h2> <p>CMS finalized its proposed update of its policies regarding residents displaced by IPF closures; the updated policy will better align with its inpatient PPS counterpart. First, the agency will now determine residents’ status as “displaced” based on the day the IPF’s or program’s closure was publicly announced, rather than the day before or day of the IPF or program’s actual closure. &nbsp;</p> <p>Second, CMS will allow the second and third groups of residents who had not started their training, but who intended to train or return to training at the closing hospital/program, to be considered displaced. These changes will allow residents to continue training and arrange transfers while the program is winding down.&nbsp;</p> <p>Third, IPFs applying for temporary increases in the full-time equivalent resident cap to accommodate displaced residents will have to submit letters to their Medicare Administrative Contractors containing specific identifying information about the residents, and do so within 60 days of the displaced residents beginning their training.&nbsp;</p> <p>CMS notes that while the updated IPF policy is consistent with the current inpatient PPS policy, the actual caps under the two payment systems may not be combined; rather, the resident cap available under the inpatient PPS is separate from that under the IPF PPS,&nbsp;and providers cannot add IPF resident caps to their inpatient PPS caps in order to increase the number of residents for which they receive payment under either payment system.&nbsp;</p> <h2>Final Changes to the IPF Quality Reporting Program (IPFQR)&nbsp;</h2> <p><u>Adoption of COVID-19 Vaccination among Health Care Personnel (HCP) Measure.</u> CMS finalized its proposal to adopt one new measure, beginning with the FY 2023 program year. This process measure, which has also been adopted in other clinical settings, evaluates the percentage of HCP eligible to work in the IPF for at least one day during the reporting period who received a complete COVID-19 vaccination course; it excludes persons with contraindications to COVID-19 vaccination as described by the Centers for Disease Control and Prevention (CDC). IPFs will submit data through the CDC’s web-based National Healthcare Safety Network (NHSN) submission framework; while other health care settings report data through NHSN, IPFs currently do not. IPFs will be required to submit this data for at least one week each month, and the CDC will calculate a summary measure of the data. This rate will be publicly reported.&nbsp;</p> <p>The measure is not endorsed by the National Quality Forum (NQF) and has not been submitted to the NQF for consideration, although it was reviewed by the NQF’s Measure Applications Partnership in this most recent cycle. Despite the lack of testing or development of this measure, CMS considered it necessary to propose the measure as soon as possible “given the novel nature of the SARS-CoV-2 virus, and the significant and immediate risk it poses in IPFs.” IPFs will be required to submit data beginning Oct. 1, 2021.&nbsp;</p> <p><u>Replacement of Follow-up after Hospitalization for Mental Illness (FUH) Measure with Follow-up After Psychiatric Hospitalization (FAPH) Measure</u>. CMS will adopt the FAPH measure beginning with the FY 2024 payment determination. This measure determines the percentage of inpatient discharges from an IPF with a principal diagnosis of select mental illness or substance use disorders (SUD) for which the patient received a follow-up visit for treatment of that diagnosed condition. Two rates will be calculated: first, visits within seven days, and second, another within 30 days of discharge. Because it is a claims-based measure, IPFs will not need to submit any data.&nbsp;</p> <p>The FAPH measure is similar to the FUH measure, but includes patients with SUD or dementia; it also does not limit the type of provider with whom the follow-up visit may be completed if the visit is billed with the relevant diagnosis. In addition, both in-person and telehealth outpatient visits are eligible, including audio-only visits. The NQF declined to endorse the FAPH measure, although the FUH measure is endorsed by the NQF. CMS will remove the FUH measure.&nbsp;</p> <p><u>Removal and Retention of Measures</u>. CMS originally proposed to remove three chart-abstracted measures from the IPQFR because the costs associated with the measures outweigh the benefits of their continued use in the program. &nbsp;<br /> However, the agency did not finalize its proposals to remove two measures: &nbsp;</p> <ul> <li>Alcohol Use Brief Intervention Provided or Offered and Alcohol Use Brief Intervention (SUB-2/2a)</li> <li>Tobacco Use Brief Intervention Provided or Offered and Tobacco Use Brief Intervention (TOB-2/2a)</li> </ul> <p>In response to certain public comments, CMS noted that not all facilities perform uniformly well on the measure. In addition, the agency cited several studies showing that alcohol use has increased during the COVID-19 pandemic, suggesting an increased need for alcohol use brief interventions. Thus, the agency now believes that the benefits of retaining the measure are greater than it had considered in its proposal, and will be retaining the measure.&nbsp;</p> <p>CMS did finalize its proposal to remove the Timely Transmission of Transition Record&nbsp;(Discharges from an Inpatient Facility to Home/Self Care or Any Other Site of Care) measure beginning with the FY 2024 IPFQR. In May 2020, the agency adopted a requirement for psychiatric hospitals that possess EHRs with the capacity to generate certain information to send at the time of these events patient admission, discharge and transfer notifications. These updated requirements overlap with, but are not the same as, the requirements for the Timely Transmission of Transition Record measure. CMS believes these competing requirements are overly burdensome, and thus will remove the measure beginning with the FY 2024 payment determination.&nbsp;</p> <p><u>Patient-level Data Submission</u>. CMS will require patient level data submission for chart-abstracted measures beginning with data submitted for the FY 2023 payment determination. Currently, data input forms within the QualityNet secure portal require the submission of aggregate data; however, the agency is concerned that aggregate data reporting increases the possibility of human error and does not allow for accuracy validation. Therefore, CMS will transition incrementally to patient-level data submission. The agency will first allow voluntary patient-level data submission for the FY 2023 payment determination (data submitted during calendar year (CY) 2022), and then mandatory patient-level submission starting with data submitted during CY 2023.&nbsp;</p> <h2>Next Steps &nbsp; &nbsp;</h2> <p>Policies will generally be effective Oct. 1.
