CMS issues checklist for states applying for waivers from ACA requirements

The Centers for Medicare & Medicaid Services today released a checklist for states applying for Section 1332 waivers. Under Section 1332 of the Affordable Care Act, states can apply for a waiver of certain ACA requirements but must demonstrate that the proposed waiver would: provide access to quality health care that is at least as comprehensive and affordable as without the waiver; provide coverage to at least a comparable number of residents; and not increase the federal deficit. According to the checklist, the departments of Health and Human Services and Treasury are interested in working with states on Section 1332 waivers that would lower premiums, improve market stability and increase consumer choice, particularly waivers incorporating a high-risk pool/state-operated reinsurance program. For example, Alaska has applied for a waiver to continue a reinsurance program it created this year to offset the cost of premium increases.
